By accessing our website, submitting a trip planning request, or engaging with our services in any way, you (“you” or “Client”) acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
If you do not agree to these Terms, you must not access or use our website or services. We reserve the right to modify these Terms at any time. Continued use of our services after any modifications constitutes your acceptance of the updated Terms.
02Description of Services
Send Me Away Travel provides complimentary, personalized travel planning and advisory services. Our services include, but are not limited to:
- Personalized trip research and itinerary planning
- Access to preferred rates, exclusive discounts, and travel perks through supplier relationships
- Cruise, hotel, resort, and tour package recommendations and booking assistance
- Honeymoon, anniversary, family, group, and solo travel planning
- Destination advice and travel guidance
- Ongoing support and communication throughout the planning process
Our travel planning services are provided at no cost to you. We are compensated through commissions paid by travel suppliers when bookings are made. This does not affect the objectivity of our recommendations.
We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice.
03Eligibility
To use our services, you must be at least 18 years of age. By using our services, you represent and warrant that:
- You are at least 18 years of age
- You have the legal authority to enter into these Terms on behalf of yourself or any party you represent
- All information you provide to us is accurate, current, and complete
- Your use of our services does not violate any applicable law or regulation
We reserve the right to refuse service to anyone for any reason at any time.
04Trip Planning Requests & Bookings
When you submit a trip planning request, you authorize us to research travel options and prepare recommendations on your behalf. The following terms apply:
No obligation to book: Submitting a trip planning request does not obligate you to make any booking or purchase. You are free to accept, modify, or decline any recommendations we provide.
Accuracy of information: You are responsible for providing accurate and complete travel information, including traveler names (as they appear on government-issued ID), dates, destinations, and any special requirements. Errors in traveler information may result in booking issues, additional fees, or cancellations for which we are not responsible.
Booking confirmation: A booking is not confirmed until you have received written confirmation from us and, where applicable, from the relevant travel supplier. Verbal or preliminary discussions do not constitute a confirmed reservation.
Payment: Pricing, payment schedules, and deposit requirements vary by supplier and will be communicated to you clearly before any booking is confirmed. All payments are subject to the payment terms of the relevant travel supplier.
Pricing: Quoted prices are subject to availability and may change until a booking is confirmed and payment is received. We are not responsible for price changes that occur prior to booking confirmation.
05Cancellations, Changes & Refunds
Cancellation and change policies vary by travel supplier, travel product, and booking type. The following general terms apply:
- All cancellations and modification requests must be submitted to us in writing (email is acceptable)
- Cancellation fees, penalties, and refund eligibility are determined by the policies of the individual travel suppliers and are outside our control
- Some bookings may be non-refundable or subject to significant cancellation penalties, which will be disclosed to you prior to booking
- We will make reasonable efforts to advocate on your behalf with suppliers in the event of cancellation or disruption, but we cannot guarantee any specific outcome
- Changes to confirmed bookings may incur supplier fees and are subject to availability
We strongly recommend the purchase of comprehensive travel insurance to protect your investment. We can provide information about travel insurance options upon request.
06Travel Insurance
We strongly encourage all clients to purchase travel insurance, including coverage for trip cancellation, trip interruption, medical emergencies, medical evacuation, and baggage loss. Travel insurance is especially important for international travel and high-value bookings.
If you decline to purchase travel insurance, we may request that you acknowledge this decision in writing. Declining travel insurance does not affect your ability to use our services, but you assume full responsibility for any losses that travel insurance would have covered.
We do not sell travel insurance directly but can provide referrals to reputable providers. Any insurance purchased is subject to the terms and conditions of the insurance provider, not Send Me Away Travel.
07Travel Documents & Requirements
You are solely responsible for ensuring that you and all travelers in your party possess the valid travel documents required for your trip, including but not limited to:
- Valid passports (with sufficient validity remaining, as required by destination countries)
- Required visas and entry permits
- Vaccination certificates or health documentation as required by your destination
- Any other documents required by airlines, cruise lines, or entry authorities
We will make reasonable efforts to inform you of known documentation requirements, but entry requirements and regulations change frequently. You are responsible for verifying current requirements with the relevant embassies, consulates, or official government sources before travel. We are not responsible for denied entry, missed travel, or costs incurred due to inadequate documentation.
08Limitation of Liability
Send Me Away Travel acts as an independent travel advisor and, where applicable, as an agent for travel suppliers including airlines, cruise lines, hotels, tour operators, and other service providers. We are not a travel supplier ourselves and do not own, operate, or control any aircraft, vessel, vehicle, hotel, or other travel facility.
To the fullest extent permitted by applicable law, Send Me Away Travel shall not be liable for:
- Any loss, damage, injury, illness, delay, or expense arising from the acts or omissions of travel suppliers
- Force majeure events including natural disasters, weather events, pandemics, acts of terrorism, civil unrest, government actions, or other events beyond our reasonable control
- Supplier insolvency, bankruptcy, or cessation of operations
- Delays, cancellations, overbooking, or changes made by travel suppliers
- Any indirect, incidental, special, consequential, or punitive damages arising from your use of our services
- Losses arising from your failure to obtain adequate travel insurance
- Losses arising from inaccurate or incomplete information you provide to us
In no event shall our total liability to you exceed the amount of any commission we received in connection with your booking, or, where no booking was made, one hundred dollars ($100.00).
09Indemnification
You agree to indemnify, defend, and hold harmless Send Me Away Travel and its principals, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:
- Your use of our services or website
- Your violation of these Terms
- Your violation of any applicable law or regulation
- Inaccurate or incomplete information you provided to us
- Any claim by a third party related to your travel
10Intellectual Property
All content on our website, including text, graphics, logos, images, and software, is the property of Send Me Away Travel or its content suppliers and is protected by applicable intellectual property laws.
You may access, view, and print content from our website for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any website content without our prior written permission.
The Send Me Away Travel name, logo, and related marks are trademarks of Send Me Away Travel. Nothing in these Terms grants you any right to use our trademarks without our prior written consent.
11Disclaimer of Warranties

We do not warrant that our website will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any content on our website, including pricing, availability, or destination information.
12Governing Law & Disputes
These Terms shall be governed by and construed in accordance with the laws of the United States and the state in which Send Me Away Travel operates, without regard to conflict of law principles.
Any dispute arising from or relating to these Terms or our services that cannot be resolved informally shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the state in which we operate, and the language of arbitration shall be English.
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm. You waive any right to a jury trial or to participate in a class action lawsuit with respect to any claims arising under these Terms.
